TERMS OF APPBACKGROUNDCHECKS.COM USE AGREEMENT

Welcome to appbackgroundchecks.com. By using appbackgroundchecks.com, you are agreeing to comply with and be bound by the following terms of use. Please review the following terms carefully. If you do not agree to these terms, you should not use appbackgroundchecks.com. The term “AP&P” or “AP&P Enterprise” or "APP ENTERPRISE COMPANY" or  “us” or “we” or “our” refers to the owner of the appbackgroundchecks.com. The term “you” refers to the user or viewer of communications or eletronic transmissions from appbackgroundchecks.com.

Acceptance of Agreement.

You agree to the terms and conditions outlined in this TERMS OF APPBACKGROUNDCHECKS.COM USE AGREEMENT ("Agreement") with respect to "appbackgroundchecks.com" (the "Site"). This Agreement constitutes the entire and only agreement for use between AP&P and you, and supersedes all prior or agreements, representations, warranties and understandings with respect to AP&P content, products or services provided by or through AP&P, unless AP&P, has an authorized copy of resolution on file.

Limited License; Permitted Uses.

You are granted a non-exclusive, non-transferable, revocable license and Agreement;

• to access and use AP&P resources strictly in accordance with this Agreement;
• to use AP&P solely as a authorized third party administrator; and
• You will only require applicants to pay (3rd party) screening fees, in compliance with RCW 59.18.257.
• You will accept AP&P screening reports.
• You will identify the applicant, before making requests to AP&P.
• You will only use payment information you are lawfully authorized to use for payment purposes.
• You will only print information from and use AP&P solely for beneficial purposes in the interest of the common good.
• No print out or electronic version of any part of AP&P or its contents may be used by you in any solicitation, litigation, arbitration, or unauthorized proceedings whatsoever under any circumstances.
• Any use, reproduction, disclosure, or dissemination of any communication is strictly prohibited, and may be subject to legal restriction or sanction.
• You understand and agree that once service has been provided,  fees paid are non-refundable.
• You shall not construe any knowledge obtained from AP&P as legal advice.
• You agree you have read, understand, and agree to our privacy policy and terms of use.
• You understand and agree that AP&P reserves the right to deny service to anyone at any time, for any reason, including you.

Limited Liability.

You hereby agree to protect, indemnify, defend and hold harmless AP&P, staff, and principals, together referred to as ("AP&P") from any liability or damages arising out of or in connection with all electronic transmissions, transactions and against any and all costs, claims, demands, damages, losses and liability (including attorneys fees and costs) arising from or in any way related to use of information or electronic transmissions received by you (or third party receiving information or electronic transmissions through you) furnished by or through AP&P or third-party data provider through AP&P.

For any legitimate work requests submitted that require FCRA approval, you agree to keep legal permissible purpose for all requests made to AP&P on record for audit.

Information produced from public information is not restricted as it is a matter of public record and does not require FCRA approval.

Legal Disclaimer. - Post required under notice from the State of Washington.

The data or information is fresh and based on information directly obtained from Washington State as of date provided to the applicant or organization;

However Washington State and AP&P:
1) Do not warrant that the information is accurate or complete, except for court purposes;
2) Make no representations regarding the identity of any persons whose names appear in the information; and
3) Deny liability for any damages resulting from release or use of the data or information.

Copyright.

The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through appbackgroundchecks.com. The posting of information or materials on appbackgroundchecks.com does not constitute a waiver of any right in such information and materials. Some of the content on appbackgroundchecks.com is the copyrighted work of third parties.

Service Marks and Trademarks.

"AP&P", "APP Enterprises", "appbackgrounchecks.com", "APP ENTERPRISE COMPANY", "ASC Information" and other variations are our service marks or registered service marks or trademarks of AP&P. Other product and company names mentioned on appbackgroundchecks.com may be trademarks or trade names of their respective owners. Other company names mentioned may be under proprietary trade contact with AP&P as Agent, Partner, Assignee, or Customer.

Amendments to Agreement.

This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on appbackgroundchecks.com, and you should review this Agreement prior to using the site.
